Terms of Service

Who these terms are between
These terms apply between you (the client) and Marketive Hub, a marketing and IT consultancy run by Mark. They cover your use of this website and any work I carry out for you. The specific details of each engagement (scope, deliverables and price) are agreed separately in writing and take precedence over anything general here.
Services provided
I provide paid media, SEO and GEO, IT services, social and content strategy, and SOP and productivity systems. Every engagement begins with a free 30-minute call and an audit. Nothing on this website is a guarantee of any particular result; marketing outcomes depend on factors outside my control, including your market and budget.
Fees and payment
The initial call and audit are free. Paid work starts from $100 and is scoped and quoted before it begins. Payment terms for each engagement are set out in the quote or agreement for that work. Invoices are due as stated on the invoice unless we agree otherwise in writing.
Scope and change requests
Each engagement is delivered to the scope we agree. Work outside that scope is a change request, which I will quote separately before starting it, so there are no surprises on either side.
Client responsibilities
To do good work I need reasonable access and timely input: accounts, assets, approvals and answers to questions. You are responsible for the accuracy of the information and materials you give me and for ensuring you have the right to use them.
Intellectual property
Once you have paid in full for an engagement, the deliverables I create specifically for you are yours to use. I retain ownership of my own pre-existing tools, templates and know-how, and may show non-confidential work in my portfolio unless we agree otherwise in writing.
Confidentiality
I keep your non-public business information confidential and use it only to deliver the work. I expect the same in return for any confidential methods or materials I share with you.
Liability
I deliver work with reasonable skill and care. To the extent permitted by law, I am not liable for indirect or consequential losses, and my total liability for any engagement is limited to the fees you paid for that engagement. Nothing in these terms limits liability where it cannot lawfully be limited.
Termination
Either of us may end an engagement with reasonable written notice. On termination you pay for work done and any costs committed up to that point, and I hand over the deliverables you have paid for.
Governing law
These terms are governed by the laws applicable at my place of business, and any dispute will be handled by the courts with jurisdiction there. If any part of these terms is found unenforceable, the rest continues to apply.
